When we say "Poldisweb", "we", "us", and "our" in these terms, we mean PoldisWeb, its subsidiaries, and its related companies and products.

When we say "services" in these terms, we mean Dead Chat Reviver ("DCR")’s services, apps, websites, and other products operated or provided by PoldisWeb.

When we say "you" or "your", we mean you as an individual user. If you are accessing our services on behalf of a legal entity (such as your employer, company, or organization), you confirm that you have the authority to bind that entity to these terms, and "you" and "your" will refer to that entity.

Our Privacy Policy and Guidelines apply to your use of our services and are incorporated into these Terms of Service by reference.

Dead Chat Reviver is licensed to you (End-User) by PoldisWeb ("Licensor"), located in Germany. By adding, downloading, or using Dead Chat Reviver, you indicate that you agree to be bound by all of the terms and conditions of this License Agreement.

The Licensor reserves all rights not expressly granted to you.
Dead Chat Reviver is designed for use within Discord Inc. ("Discord"). Use of Discord is subject to the Discord Terms of Service.

1. THE APPLICATION

Dead Chat Reviver ("Application") is a software service created to help revive inactive Discord servers and channels by sending automated messages, conversation starters, and pings. It is designed for entertainment and community engagement purposes only.

2. TECHNICAL REQUIREMENTS

2.1 The Application requires an active Discord account and sufficient permissions to operate within a server.
2.2 PoldisWeb strives to keep the Application updated to remain compatible with new Discord features and API changes, but no guarantee is made that the Application will remain functional indefinitely.
2.3 You are responsible for ensuring that your use of the Application complies with Discord’s rules and technical limitations.
2.4 PoldisWeb may modify or discontinue the Application at any time, temporarily or permanently, without prior notice.

3. MAINTENANCE AND SUPPORT

3.1 PoldisWeb is solely responsible for providing maintenance and support for this Application. You can reach us at the email address listed below.
3.2 Discord Inc. and any third-party AI providers have no obligation to provide maintenance or support for Dead Chat Reviver.

4. USE OF DATA AND AI SERVICES

By using our services, you agree that we may process and transmit certain data as described in our Privacy Policy.

Some features of Dead Chat Reviver may use artificial intelligence (AI) technologies provided by third parties. These may include, but are not limited to, Google’s Generative AI platform (Gemini API) and large language models accessed via Groq (e.g. LLaMA-based models), as well as other comparable AI providers that may be introduced or replaced over time. When you use AI-powered features, your input (such as text, messages, or uploaded content) may be transmitted to one or more of these third-party providers for processing.

According to Google’s AI Terms of Service and Google’s Privacy Policy, data submitted to Google’s AI services may be used to provide, maintain, and improve their AI models and related products. Data processed by other AI providers (such as Groq) is subject to their respective terms of service and privacy policies.

Do not input confidential, personal, or sensitive information into AI-related features. By using these features, you consent to the processing of your data by Google, Groq, and other third-party AI service providers as described above and in our Privacy Policy.

5. USER CONTRIBUTIONS

You are not required to contribute content to the Application. If you choose to do so, you are responsible for ensuring that you have the right to share it and that your content does not violate any law or the rights of others. We reserve the right to remove or restrict content that violates these terms, our Guidelines, or applicable law.

By submitting feedback or ideas, you grant PoldisWeb a non-exclusive, perpetual, irrevocable, transferable license to use such feedback without any compensation or attribution.

6. LIMITATION OF LIABILITY

To the maximum extent permitted by law, PoldisWeb shall not be liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use the Application, including data loss, service interruptions, or damages caused by third-party integrations (e.g., Discord or Google).

The Application is provided “as is” and “as available” without warranties of any kind, whether express or implied.

7. WARRANTY

7.1 PoldisWeb warrants that the Application is free of malicious software at the time of release and operates as described.
7.2 No warranty is given if the Application has been modified, misused, or used in violation of Discord’s or our terms.
7.3 If a defect is confirmed, PoldisWeb may attempt to correct it or provide a substitute version, at its discretion.

8. LEGAL COMPLIANCE

You represent and warrant that you are not located in a country subject to a U.S. government embargo or listed as a restricted or prohibited party under U.S. or EU sanctions.

10. TERMINATION

Your license to use the Application remains in effect until terminated by PoldisWeb or by you. We may terminate or suspend your access to the Application at any time, with or without notice, if you violate these terms. Upon termination, you must stop all use of the Application and delete any stored copies.

11. INTELLECTUAL PROPERTY RIGHTS

The Dead Chat Reviver bot, its code, features, and branding are the intellectual property of Leopold Scharlach (PoldisWeb).
All trademarks, logos, and related materials are protected under applicable intellectual property laws.

12. APPLICABLE LAW

This License Agreement is governed by and construed in accordance with the laws of Germany, excluding its conflict of law provisions. The courts of Germany shall have exclusive jurisdiction over disputes arising from or relating to this Agreement.

13. MISCELLANEOUS

13.1 If any part of this Agreement is found to be invalid or unenforceable, the remaining provisions will remain in effect. The invalid clause will be replaced by one that best reflects the intended purpose.

13.2 Any changes or amendments must be made in writing.

13.3 PoldisWeb reserves the right to update or modify these Terms at any time. Continued use of the Application after such updates constitutes acceptance of the revised terms.
